JOHANNESBURG (Reuters) - Workers have reached a deal with Anglo American Platinum to reinstate 12,000 miners sacked for an illegal strike, which could end the last big industrial action rocking South Africa's mining sector.
Months of often violent wildcat strikes have cut production in the platinum and gold sectors, raising concerns about slowing economic growth as well as awkward questions about President Jacob Zuma's management of the most damaging labor strife since the end of apartheid in 1994.
"They agreed to reinstate all the dismissed workers on the provision that they return to work by Tuesday," Lesiba Seshoka, spokesman for the powerful National Union of Mineworkers (NUM), told Reuters on Saturday.
Seshoka said he expected workers would return to their posts and "that will mean the end of the strike".
Anglo American Platinum, or Amplats, said in a separate statement it had reached the deal with several unions and offered sweeteners such as a one-off hardship payment of 2,000 rand (142.77 pounds) to facilitate the return. The strike has lasted about six weeks and crippled production.
"Employees who do not return to work on Tuesday ... will remain dismissed and/or be subjected to the illegal strike disciplinary action and will not be eligible for any of the benefits mentioned above," it said in a statement.
While tensions may be winding down at Amplats mines, police in the platinum belt city of Rustenburg were reported to have fired rubber bullets and used stun grenades at a labor rally on Saturday to separate NUM members from other workers who have been fighting a deadly turf war for support.
South African media said the clash took place about 120 km (80 miles) northwest of Johannesburg. Police said they could not confirm the incident.
In recent days, several wildcat strikes over wages and working conditions in the gold sector have come to an end with employers sacking, or threatening to sack, miners striking illegally.
South African labor law requires clear formal processes for strikes and walk-outs. Those that do not go through all the proper hoops are considered illegal, and can result in striking workers being sacked.
Mining firms usually reinstate dismissed workers because it is more expensive to train a new workforce. But some of the job losses could be permanent with employers using the labor strife to shut down marginal mines in South Africa.
ANC ELECTION
The deal at Amplats comes after Cynthia Carroll, chief executive of parent Anglo American, announced her resignation on Friday. She had come under pressure from investors over the firm's lagging share price and continued dependence on strike-hit South Africa.
Anglo owns 77 percent of Anglo American Platinum. Although responsible for 24 percent of its parent's 2011 revenue, Amplats brought in just 8 percent of total operating profit because of soaring costs.
If the workers do return to Amplats, Zuma will have likely weathered a labor storm that threatened to cause problems for him as he seeks re-election as leader of the ruling African National Congress at a party meeting in December.
If Zuma wins the race to lead the party that dominates South African politics, he will be on a path to remain the country's president for another term lasting until 2019.
Zuma has called on wildcat strikers to return to work, pledged to speed up a massive infrastructure program to improve living conditions in the mining belt and held a high-level meeting with labor and industry trying to break the impasse.
Critics saw these moves as mostly symbolic, doing little to ease the tension and saying hardball negotiation tactics from employers and weeks of lost wages had more of an effect in ending many of the strikes.
Local media said Zuma appeared to have an edge in the ANC race, in which about 4,500 local branch delegates will select the party's leaders. Zuma's foes, who see him as an ineffectual leader, could be emboldened if labor tensions flare again.
Many strikers accuse ANC leaders and their labor allies of worrying too much about their political ties and not showing enough concern for miners working deep underground.
The strikes have highlighted persistent glaring income inequality in South Africa, which has increased since Nelson Mandela's ANC took over following the end of white-minority rule in 1994, promising "a better life for all".
Zuma has come in for particular criticism for not responding faster to the August 16 police killing of 34 strikers at Lonmin's Marikana platinum mine, the bloodiest security incident since the end of white-minority rule in 1994.

WASHINGTON (AP) ? What gender gap?
Less than two weeks out from Election Day, Republican Mitt Romney has erased President Barack Obama's 16-point advantage among women, a new Associated Press-GfK poll shows. And the president, in turn, has largely eliminated Romney's edge among men.
Those churning gender dynamics leave the presidential race still a virtual dead heat, with Romney favored by 47 percent of likely voters and Obama by 45 percent, a result within the poll's margin of sampling error, the survey shows.
After a commanding first debate performance and a generally good month, Romney has gained ground with Americans on a number of important fronts, including their confidence in how he would handle the economy and their impressions of his ability to understand their problems.
At the same time, expectations that Obama will be re-elected have slipped: Half of voters now expect the president to win a second term, down from 55 percent a month earlier.
For all of the good news for Republicans, however, what matters most in the election endgame is Romney's standing in the handful of states whose electoral votes still are up for grabs. And polls in a number of those battleground states still appear to favor Obama.
As the election nears, Romney has been playing down social issues and trying to project a more moderate stance on matters such as abortion in an effort to court female voters. The AP-GfK poll, taken Friday through Tuesday, shows Romney pulling even with Obama among women at 47-47 after lagging by 16 points a month earlier.
But now his campaign is grappling with the fallout from a comment by a Romney-endorsed Senate candidate in Indiana, who said that when a woman becomes pregnant during a rape "that's something God intended."
Romney quickly distanced himself from the remark by Republican Richard Mourdock. But Obama campaign spokeswoman Jen Psaki said the incident was "a reminder that a Republican Congress working with a Republican President Mitt Romney would feel that women should not be able to make choices about their own health care."
A renewed focus on social issues would be an unwelcome development for Romney: Among female likely voters, 55 percent say Obama would make the right decisions on women's issues, compared with 41 percent who think Romney would.
Romney's pitch to women has been focused squarely on the economy, making the case that what women want most is to ensure their families and their country are on a solid financial footing. The poll shows that message appears to be taking root.
A month ago, women favored Obama over Romney on the economy 56 percent to 40 percent. Now, the split has shifted to 49 percent for Romney and 45 percent for Obama.
Similarly, Obama's lead among women as the candidate who better understands the people's problems has narrowed considerably, from a 58-36 Obama advantage last month to a 50-43 Obama edge now.
Monica Jensen, a 55-year-old independent from Mobile, Ala., says she voted for Obama in 2008 but will shift her vote to Romney this time, largely because of the economy.
"I'm ready for a change," she said. "I want to see the economy go in a different direction."
Ginny Lewis, a Democrat and 72-year-old retired district attorney from Princeton, Ky., says she'll vote for Romney because "I'm tired of the Republicans blaming all the debt on Democrats, so let them take over and see what they do."
Not that she's optimistic about how that will turn out, though. "I think things will get worse before they get better," she said.
Lindsey Hornbaker, a 25-year-old graduate student and nanny, hasn't been swayed by Romney's charm offensive.
Hornbaker, interviewed Wednesday in Davenport, Iowa, where she was attending an Obama rally, said Romney can tweak his tone but not what she sees as a record focused far more on top income earners and out of touch with most working families.
"I heard him go out of his way to sound so moderate during the debate," she said. "And I thought: 'Who is this? Where did this come from?' He may sound like he's focused on the middle class. But where's the record?"
Obama, meanwhile, has been working to shore up his support among men, who tend to be more Republican than women. In the 2008 election, men broke 49 percent for Obama to 48 percent for John McCain, even though Obama got 53 percent of the vote overall. The president's job approval ratings among men have tended to fall below his ratings among women throughout his first term.
A month ago, Romney's advantage among men was 13 percentage points. Now, it's down to 5 points, with most of the shift toward Obama coming among unmarried men.
Obama's election chances hinge on turning out voters like Jon Gerton, a disabled construction worker from Jonesboro, Ark. Gerton's a staunch Obama supporter ? but he didn't vote in 2008.
"It takes longer than four years to get things to the point where things are going better," Gerton said. "Four years, it's not very long."
There has been a gender gap in every presidential election since 1980. In 2008, women were 7 percentage points more likely than men to vote for Obama.
Overall, people are significantly more optimistic about the economy and unemployment in the coming year than they have been at any point in AP-GfK polling going back to March 2011, when the poll first started asking those questions. And likely voters are even more optimistic than other adults.
Nearly six in 10 likely voters think the economy will improve in the next year, up from 46 percent last month. And 42 percent think the number of unemployed Americans will drop in the next year, up from 32 percent in September.
Count Chrysta Walker, of Cedar Lake, Ind., among the voters who are sticking with Obama because they think he's got the right solutions for the fragile economy.
"He's got the middle class at heart," says the 58-year-old Walker. On the economy, she says, Obama "did as well as could be expected because he didn't get a lot of cooperation."
David Bierwirth, who owns an autograph sales business in Las Vegas, turned out at a Romney rally in Henderson this week to show his support for the GOP nominee. To Bierwirth, his vote for Romney is all about the economy.
"I want people back to work," he says, "because then they will buy my products."
The Associated Press-GfK poll was conducted Oct. 19-23 by GfK Roper Public Affairs & Corporate Communications. It involved landline and cellphone interviews with 1,186 adults nationwide, including 839 likely voters. Results for the full sample have a margin of sampling error of plus or minus 3.5 percentage points; for likely voters it is 4.2 points.

When you buy media online, it often comes protected with DRM, so you're forced only to use it in the way iTunes, Amazon, or whoever else intended. Buy from a source that doesn't use DRM, and you'll be much happier.
Like OS X but don't want to shell out for one of Apple's insanely expensive, uncustomizable computers? Build a desktop PC and hack it to run OS X instead. It's shockingly easy to do these days, will save you a ton of money, and give you much more room to configure your hardware and upgrade it later on. If you're looking for something more akin to a Mac Mini, you can build a small, inexpensive Hackintosh too.
Tired of being told what you can and can't do with your own phone? It's time to jailbreak it. If you're on iOS, jailbreaking is pretty easy as long as you have the right version of iOS, and it allows you to do all sorts of awesome things: customize the interface, play classic video games, or even tether your internet for free. Android users have to go through the somewhat more complicated process of rooting, but then you have serious access to the ins and outs of your device. Apart from awesome root-only apps, you can flash custom versions of Android called ROMs, get better battery life with a new kernel, or just speed the darn thing up with some deep settings tweaks. Whatever you do, you'll wonder how you ever lived without jailbreaking or rooting.

ScienceDaily (Oct. 20, 2012) ? Cyberbullying -- the use of the Internet, phones or other technologies to repeatedly harass or mistreat peers -- is often linked with teen suicide in media reports. However, new research presented on Oct. 20, at the American Academy of Pediatrics (AAP) National Conference and Exhibition in New Orleans, shows that the reality is more complex. Most teen suicide victims are bullied both online and in school, and many suicide victims also suffer from depression.
For the abstract, "Cyberbullying and Suicide: A Retrospective Analysis of 41 Cases," researchers searched the Internet for reports of youth suicides where cyberbullying was a reported factor. Information about demographics and the event itself were then collected through searches of online news media and social networks. Finally, descriptive statistics were used to assess the rate of pre-existing mental illness, the co-occurrence of other forms of bullying, and the characteristics of the electronic media associated with each suicide case.
The study identified 41 suicide cases (24 female, 17 male, ages 13 to 18) from the U.S., Canada, the United Kingdom and Australia. In the study, 24 percent of teens were the victims of homophobic bullying, including the 12 percent of teens identified as homosexual and another 12 percent of teens who were identified as heterosexual or of unknown sexual preference.
Suicides most frequently occurred in September (15 percent) and January (12 percent) although these higher rates may have occurred by chance. The incidence of reported suicide cases increased over time, with 56 percent occurring from 2003 to 2010, compared to 44 percent from January 2011 through April 2012.
Seventy-eight percent of adolescents who committed suicide were bullied both at school and online, and only 17 percent were targeted online only. A mood disorder was reported in 32 percent of the teens, and depression symptoms in an additional 15 percent.
"Cyberbullying is a factor in some suicides, but almost always there are other factors such as mental illness or face-to-face bullying," said study author John C. LeBlanc, MD, MSc, FRCPC, FAAP. "Cyberbullying usually occurs in the context of regular bullying."
Cyberbullying occurred through various media, with Formspring and Facebook specifically mentioned in 21 cases. Text or video messaging was noted in 14 cases.
"Certain social media, by virtue of allowing anonymity, may encourage cyberbullying," said Dr. LeBlanc. "It is difficult to prove a cause and effect relationship, but I believe there is little justification for anonymity."

Can we please take a moment to discuss bullying and how it is affecting our youth? When our parents were young, the kids that picked on the ?geeks? were called ?bullies?, but the extent of the ?bullying? was generally nothing that could hold a flame to what children/teens are experiencing in 2012. Bullying has the power to drive them to self destruction, eating disorders, anxiety disorders, depression, isolation? the list can go on and on. In one sentence- bullying is causing individuals to hurt themselves and others? we have to find a way to stop this.
Included in this article is the information for an event happening this coming Sunday October 21tst in Stroudsburg, PA. The parties involved have come together to raise awareness to the effects of bullying and are trying to spread the word of its venom in attempts to stop it. This is something close to my heart and I thought I would tell?my story:
I personally was at the receiving end of torturous bullying for over 3 years in high school. Now as an adult, I think back to how juvenile it all was and can brush it off, but it was quite the contrary as a teen. I was bullied by 7 girls in the grades above me from 9th grade through 11th. To this day I can name each girl and each moment they affected me.
In the 9th grade I was walking down the packed halls of my small, suburban, mid-west high school with a girlfriend and heard some commotion behind me. I looked over my shoulder to see a group of girls laughing, but thought nothing of it. Moments later, I was being pushed down a stairwell only to crash at the bottom along with the multiple classmates I had taken down with me. At the top of the stairs I saw the same group of girls laughing, but again, really thought nothing of it. Not more then 5 minutes went by before I was cornered at my freshman locker by these very same girls that, at the time, I couldn?t name if you paid me. I had no idea why they were there, who they were or what they wanted with me. They kept screaming in my face things like ?do you know who I am b*#!h?? along with every derogatory name they could muster up. Conveniently, this happened during class change, so you can imagine the plethora of faces I had staring at me.
I would like to backtrack for a moment and mention that the night before this all happened, I had unexpectedly lost my great grandmother. She was one of the dearest and most special people in my life, one that to this day I mourn the loss of daily. Needless to say, when these events took place I was in no position to put up a fight. I was completely baffled and already so drained; they ?smelled the blood? and came in for more.
I do not recall how the screaming and shoving at my locker stopped, but it didn?t stop for long. About 15 minutes later, the girls appeared in the locker room as I was changing for gym. They, along with a few faces added to their posse, cornered me to continue with the screaming and name calling. I broke down and I started to cry. I wanted to know why were they bothering me and who they were. The fact that I finally shed tears excited them. I begged them to stop. At this point a friend of mine had chimed in something along the lines of ?leave her alone, she lost her grandmother last night?, but they thought this was hysterical. I very clearly remember one of them saying ?good, now she doesn?t have to deal with you anymore?. I cannot remember another time in my young adult life that I was more confused and alone then in that locker room.
From that day on, I walked the halls of my high school in fear of what was going to happen next. Often, they screamed awful things at me with full hallways. They threw their lunches at me, followed me to sporting events after school and harassed me there too. I, at one point, had an entire stall in my high school bathroom dedicated to calling me awful names. I would often hear from friends that there was a new phrase or curse referring to me. Many times, the school would paint over the black permanent marker, but it would be back in just a few days. I often missed school or went to the nurse?s office just to get away from it. My parents came to the school, my mom came with me to the sporting events, my father threatened to sue, but it did nothing. The girls started coming into my work where they knew I had to be kind to them. There, they would make their comments knowing I had to smile through it for the sake of my job.
One day it did stop. After 3+ years, I finally had enough. While I was walking the empty halls, the ?ring leader? of this girl posse was perched on a railing with one of my male classmates. She pulled her usual name calling routine, but this time I did not just keep walking and hang my head. I finally screamed back. I let it all out and let me tell you; the look in her eyes showed her fear. This look was no doubtably the same look they saw on my face the day this all began. The difference between her and I? I didn?t get pleasure out of her fear. I simply wanted to be left alone. This was they day it all began to stop. Word must have spread amongst the girls because the bullying dwindled quickly. When they got brave and tried for a bit more, I fought back with a vengeance (figuratively, not physically).
In the middle of my 11th grade year, I was finally free. It stopped. I still get angry when I think of all that they did to me, but I am grateful. Their torture made me stronger and taught me to be heard; to stand up for myself. I went to years of therapy to gain back the confidence they so successfully took from me and can now look back with pity for them. I might get angry on occasion, but I wish them well. We were kids and obviously their parents did not teach them compassion and kindness. I sincerely hope they never have to comfort their child who is at the receiving end of bullying.
Following my run with these girls in high school, I participated in a group that worked to bring awareness to bullying. I spoke at convention centers to teens, did TV shows and mentored others going through it. This was 10 years ago. I am saddened that it has taken this long for those at the receiving end of bullying to finally find a voice. Children and teens are getting hurt, they are harming themselves, they are harming others. It has to end and the severity of bullying needs to be heard. The only way this will stop is to talk about it. I am a stronger woman today because of my experience, but not everyone comes out that way. We need to take it seriously and we need to act. Rating Action On Oct. 18, 2012, Standard & Poor's Ratings Services assigned its 'B'
long-term corporate credit rating to Indonesian exploration and production (E&P) company PT
Energi Mega Persada Tbk. (EMP). The outlook is positive. At the same time, we assigned our 'B'
issue rating to a proposed issue of senior secured notes that EMP and its subsidiaries
guarantee. EMP's subsidiary, EMP International Holdings Pte. Ltd., will issue the notes. The
rating on the proposed notes is subject to our review of the final issuance documentation. EMP
is a holding company that has interests in production sharing contracts in various oil and gas
blocks.
Rationale
The rating on EMP reflects the company's large capital expenditure requirements relative to
its free cash flow generation. The rating also reflects the limited track record of EMP's
development blocks, and the company's exposure to volatile oil prices and asset concentration in
Indonesia. EMP's good growth potential in its blocks, long-term fixed-price gas sales contracts,
and the favorable outlook for energy demand in Indonesia, particularly for gas, temper the above
weaknesses. The rating is based on our assumption that that the company will refinance its debt
with the proposed notes.

Well, this has got us scratching our collective heads. Yesterday, Google was fairly certain that its latest and greatest Chromebook would be a WiFi-only affair. Today, however, and a listing has appeared on the company's official website and Amazon that shows a 3G-enabled version is available for $329.99. Neither site mentions network options, so presumably you get the same 100MB a month for two years Verizon data that its brethren receive -- and given that we described it as being "80 percent of the MacBook Air experience for a quarter of the price," the 3G version seems well worth the extra $80.

DENVER (AP) ? It's not all hippies backing November's marijuana legalization votes in Colorado, Oregon and Washington.
Appealing to Western individualism and a mistrust of federal government, activists have lined up some prominent conservatives, from one-time presidential hopefuls Tom Tancredo and Ron Paul to Republican-turned-Libertarian presidential candidate and former New Mexico Gov. Gary Johnson.
"This is truly a nonpartisan issue," said Mark Slaugh, a volunteer for the Colorado initiative who is based in Colorado Springs, which has more Republicans than anywhere else in the state.
"States' rights! States' rights!" Slaugh cried as he handed out flyers about the state's pot measure outside a rally last month by Republican vice presidential candidate Paul Ryan. Quite a few passing Republicans took the flyer.
"It's fiscally prudent. It would be taxed, regulated, monitored. It makes a lot of sense to Republicans," he said.
Most Republicans still oppose legalization. Presidential candidate Mitt Romney vows to enforce federal law. When Ryan told a Colorado Springs TV station in September that medical marijuana was "up to Coloradans to decide," his campaign quickly backtracked and said he agreed with Romney.
When activists make their appeal, it goes like this: States should dictate drug law. Decades of federal prohibition have failed where personal responsibility and old-fashioned parenting will succeed. Politicians back East have no business dictating what the states do.
"What is the law against marijuana if it isn't the Nanny State telling you what you can do and what you can't do to your body and with your body?" asked Tancredo, a former Republican congressman from suburban Denver who briefly ran for president in 2008 and endorsed the measure on the steps of the state capitol. He compared federal law to New York City's ban on sugary sodas.
Tancredo launched a radio ad this week in which he compares marijuana prohibition to alcohol prohibition as a "failed government program" that, in this case, "steers Colorado money to criminals in Mexico."
"Proponents of big government have duped us into supporting a similar prohibition of marijuana ? even though it can be used safely and responsibly by adults," Tancredo said.
Pot supporters have lined up other surprising allies this year, even as many Democrats oppose the measures. Conservative stalwart Pat Robertson, for example, said marijuana should be legal.
In Washington state, Republican U.S. Senate hopeful Michael Baumgartner is running a longshot bid to unseat Democratic U.S. Sen. Maria Cantwell, who opposes it.
"It's taking a different approach to a very expensive drug war, and potentially a better approach," he said.
In Oregon, at least one Republican state Senate candidate backs legalization. Cliff Hutchison reasoned that legalizing pot would "cut wasteful government spending on corrections and reduce drug gang violence."
Johnson, the Libertarian candidate, is fiscally conservative but supports such liberal causes as legalizing marijuana, immigration reform and abortion rights. He's said that if elected he would pardon all non-violent prisoners convicted of marijuana-related offenses in federal court.
Pro-pot conservatives have counterparts on the other side ? Democrats who say pot shouldn't be legal without a doctor's recommendation. Democratic governors in Colorado and Washington oppose legalization. Oregon's Democratic governor has not taken a stand.
President Barack Obama's administration has shut down medical marijuana dispensaries in California and Colorado.
Republican Colorado state Sen. Steve King is a frequent critic of Colorado's medical marijuana law. Conservatives abhor government, but they also fear legalization would increase children's drug use, he said. "It's pretty easy to come in and say, 'Let's decrease government.' And I'm all for that. This just isn't the place to start," King said.
"We have a next generation to protect," he said.

Honduras has submitted a request for the formation of a dispute settlement panel at the World Trade Organization regarding a tobacco plain-packaging law Australia has passed for public health reasons.
The request will be on the agenda of the next WTO Dispute Settlement Body meeting, scheduled for 19 November, according to WTO sources.

The following communication, dated 15 october 2012, from the delegation of Honduras to the Chairperson of the Dispute Settlement Body, is circulated pursuant to Article 6.2 of the DSU.

On 4 April 2012, Honduras requested consultations with Australia pursuant to Article 4 of the Understanding on Rules and Procedures Governing the Settlement of Disputes (the ?DSU?), Article?64.1 of the Agreement on Trade-Related Aspects of Intellectual Property Rights (the ?TRIPs Agreement?), Article 14.1 of the Agreement on Technical Barriers to Trade (the ?TBT Agreement?), and Article XXII of the General Agreement on Tariffs and Trade 1994 (the ?GATT 1994?).? This request for consultations concerned certain Australian laws and regulations that impose restrictions on trademarks and geographical restrictions as well as other plain packaging requirements on tobacco products and packaging (the ?measures?).
Consultations were held on 1 May 2012 with a view to reaching a mutually satisfactory solution.? These consultations clarified certain issues pertaining to this matter, but failed to resolve the dispute.? Therefore, as specified below, Honduras requests that the Dispute Settlement Body (the ?DSB?) establish a panel to examine this matter.
Australia regulates the appearance of marks and other design features on the retail packaging of tobacco products, as well as on the tobacco products themselves.? It regulates the appearance of the brand, business, company or variant name in a standard form, font size and location. It prescribes the colour and the finish of retail packaging for all tobacco products and also prescribes the requirements for wrappers, inserts and onserts. In particular:
?? The brand, business or company name on the retail packaging must be printed in Lucida Sans typeface in regular font no larger than 14 points in Pantone Cool Gray 2C. The variant name must meet these requirements but cannot be larger than 10 points.
?? All retail packaging for tobacco products must have a matt finish and be in drab dark brown (Pantone 448C), with the exception of the health warnings, the text of the brand, business, company or variant name and the relevant legislative warnings.
Non-cigarette tobacco products, such as cigars, may include a band in Pantone 448C, on which the following marks may appear: the brand, company or business name and variant name, the name of the country in which the cigar was made or produced, and an alphanumeric code. ?These marks may each appear only once on the band and must be printed in Lucida Sans typeface, no larger than 10 points in regular font in Pantone Cool Gray 2C.
Honduras understands that Australia maintains these measures through the following instruments:
?? Tobacco Plain Packaging Act 2011, Act No. 148 of 2011, ?An Act to discourage the use of tobacco products, and for related purposes?;
?? The Tobacco Plain Packaging Regulations 2011, Select Legislative Instrument 2011, No. 263 as amended by the Tobacco Plain Packaging Amendment Regulation 2012 (No. 1), Select Legislative Instrument 2012, No. 29.? These regulations apply to the retail packaging and appearance of both cigarettes and non-cigarette tobacco products; and,
?? The Trade Marks Amendment (Tobacco Plain Packaging) Act 2011; Act No. 149 of 2011, ?An Act to amend the Trade Marks Act 1995 and for related purposes?.
In addition to the instruments listed above, this request covers any amendments, extensions, related instruments or practices.
These measures regulating the plain packaging and appearance of tobacco products for retail sale appear to be inconsistent with Australia?s obligations under the following provisions of the TRIPs Agreement, the TBT Agreement and the GATT 1994:
?? Article 20 of the TRIPs Agreement, because the use of a trademark is unjustifiably encumbered by special requirements, such as (i) use in a special form, for example, the specific font size and colour of the brand, business or company name,? and,? (ii) use in a manner detrimental to the trademark?s capability to distinguish tobacco products of one undertaking from tobacco products of other undertakings;
?? Article 16.1 of the TRIPs Agreement, because the measures prevent owners of registered trademarks from enjoying the rights conferred by a trademark;
?? Article 15.4 of the TRIPs Agreement, because the nature of the goods to which a trademark is to be applied forms an obstacle to the registration of the trademark;
?? Article 2.1 of the TRIPs Agreement, which incorporates provisions of? the Paris Convention for the Protection of Industrial Property, as amended by the Stockholm Act 1967 (?Paris Convention?), in particular (i) Article 6quinquies of the Paris Convention, because trademarks registered in a country of origin outside Australia are not protected ?as is?, and, (ii) Article?10bis of the Paris Convention, because Australia does not provide effective protection against unfair competition to nationals of other countries of the Union and creates confusion between goods of competitors;
?? Article 24.3 of the TRIPs Agreement, because Australia is diminishing its level of protection for geographical indications as compared with the level of protection that existed prior to 1 January 1995;

MOMBASA, Kenya (Reuters) - Kenyan police arrested the leader of the separatist Mombasa Republican Council (MRC) and shot dead two supporters in a house raid on Monday, intensifying a crackdown on the movement seeking independence for the country's coastal region.
Dozens of youths, some armed with machetes and clubs, who tried to prevent officers from detaining Omar Mwamnuadzi were also detained and a number of crude weapons seized, Coast province police chief Aggrey Adoli said.
The MRC is campaigning for the secession of the Indian Ocean coastal strip - a tourist hotspot and trade hub - and threatens to disrupt next March's general election if its demand is not met, raising fears of violence.
The election will be the first since an international war crimes court charged four Kenyans with masterminding deadly tribal bloodletting after a disputed 2007 vote.
Kenya's government said last week it had information that the MRC intended to sow chaos during national exams that began on Monday.
"These are not threats to take lightly. That is why you are seeing these crackdowns and they will not stop until we have dealt completely with the threat," Internal Security Minister Katoo Ole Metito told local lawmakers and security chiefs in Mombasa. "There will be peaceful elections in Coast and our (school exam) candidates will sit exams in peace."
After the morning raid in Kwale 20 km (12 miles) south of Mombasa, Mwamnuadzi was seen being escorted out of a police cell in the early afternoon in blood-stained clothing. His face looked swollen and covered in dry blood and he had to be supported as he was lifted into a police truck.
GRIEVANCES
The MRC's grievances stem from what it calls decades of social and economic marginalization of the people in the coastal region of Kenya, east Africa's largest economy.
Over the weekend Mohammad Dor, a legislator and prominent Muslim cleric from the region, accused the Nairobi government of harassing the MRC, which he said had legitimate grievances.
"What is wrong with funding MRC? These are people with genuine concerns. I am willing and ready to fund them if they approach me," he told reporters in Mombasa, the region's biggest port and main city.
Kenya's coastline is a magnet for foreign tourists and jewel of the economy with its white sand beaches and turquoise waters, while Mombasa is a critical commercial center for Kenya and export outlet for its landlocked neighbors.
Dor spoke a few days after the government said it was investigating three politicians and two businessmen it believed were funding the MRC.
Another senior MRC official, Mwero wa Mwadadu, said police had beaten up numerous supporters during Monday's dawn raid and he denied that the group intended to disrupt the school exams.
"They have been looking for us (and) framing us for crimes we haven't committed," Mwadadu told Reuters. "We mean peace. We don't mean to disrupt exams, those are false allegations, but what we don't want are elections in coast."
Earlier this month MRC spokesman Mohamed Mraja and secretary Randu Nzai Ruwa were charged with inciting members to disobey the law, shortly after a gang of youths brandishing machetes attacked a cabinet minister and killed his bodyguard.
Police linked the attack to the MRC, but the group denied involvement.
